For serious constitutional violations, as well as violations of international conventions on freedoms and human rights by the investigation and prosecution authorities, yesterday the Court of Cassation ordered the release of the five minority members previously sentenced.
The trial began yesterday morning at around 9:00. The panel, chaired by Aranit Çela and composed of members Dhamo, Tase and Sulcebeja, as well as the session secretary, after the five minority defendants were brought into the courtroom and the previous verdict was read, began examining the case.
Many representatives of the domestic and foreign press, diplomats, as well as relatives of the defendants, took part in the hearing. The defense objected to the way the investigation had been conducted and argued that the defendants’ procedural and constitutional rights had been violated.
During the hearing, irregularities were noted in the taking of statements, the absence of an interpreter where necessary, as well as elements of psychological pressure on the defendants. It was emphasized that part of the evidence had been obtained in violation of the law.
The court, after withdrawing to deliberate, announced that the five minority members were guilty, but decided to release them. The decision was awaited with great interest in the courtroom and outside it.
In its reasoning, it emphasized that during the investigative and judicial process serious violations of Albanian constitutional law and of the international conventions on freedoms and human rights were found.

But what does yesterday’s trial offer?
Alongside the testimonies discussed at the hearing, yesterday’s trial also brought attention to the way the preliminary investigation was conducted, respect for the rights of the defense, as well as the use of evidence. Discrepancies were noted between earlier statements and those made in the courtroom.
There was talk of the lack of full procedural guarantees and of the impact these shortcomings may have had on the decisions of the earlier instances. The defense insisted that without respect for the law, there can be no lasting justice.
